Following the introduction of an extreme package of austerity measures and the consequent protest actions organized by the Romanian unions on the new Labour Code, the Romanian Government is now attacking the laws on social dialogue which provide the basis for labour relations in the country: the law on trade unions, on employers’ organisations and functioning of social dialogue. Government proposals will undermine representativity of trade unions on different levels and trade union pluralism, eliminate the national collective bargaining and leave trade union leaders without legal protection. The changes proposed by the Romanian Government will further dilute the protection of workers' rights on the individual level by opening to abuse from the part of employers. The Government has ignored the expert opinion of the ILO defining the text of the labour law as violation of ILO labour standards; now the Government is sending its own draft for the Social dialogue laws for voting in Parliament without consultation with the social partners and not taking into consideration the ILO standards. We want to address to you, Prime Minister and presidents of the parliamentary parties, to urge the Government to listen to the voice of the workers and social partners and to respect the rights validated in the international conventions related to the labour legislation. - 2 - We extend our solidarity to all Romanian workers fighting for their cause and the future of social dialogue in Romania. Yours sincerely, General Secretary Stimate domnule Prim Ministru, Stimati Presedinti ai Partidelor Parlamentare, Va scriu pentru a exprima sprijinul Confederatiei Internationale a Sindicatelor si al Consiliului Regional Pan-European privind cererile exprimate de catre sindicatele romanesti referitoare la prevederile inacceptabile ale noii legi a dialogului social ce urmeaza a fi adoptata de catre Guvernul Romaniei. Ca urmare a introducerii unui pachet de masuri de austeritate extrema si a actiunilor de protest ulterioare, organizate de catre organizatiile sindicale din Romania privind noul Cod al Muncii, Guvernul Romaniei ataca acum legea dialogului social care reprezinta baza pentru relatiile de munca din Romania: legea sindicatelor, legea patronatelor si functionarea dialogului social. Propunerile Guvernului vor submina reprezentativitatea sindicatelor la diferite niveluri si pluralismul sindical, vor elimina negocierile colective la nivel national si ii lasa pe liderii sindicali fara protectie legala. Schimbarile propuse de catre Guvernul Romaniei vor dilua drepturile privind protectia lucratorilor la nivel individual, permitand abuzul din partea angajatorilor. Guvernul a ignorat opinia expertului OIM care a definit textul legii muncii ca fiind o violare a standardelor OIM; acum, Guvernul isi trimite propriul proiect pentru legea dialogului social, pentru a fi votata in Parlament fara o consultare cu partenerii sociali si fara sa tina cont de standardele OIM. Domnule Prim Ministru si domnilor Presedinti ai Partidelor Parlamentare, dorim sa va solicitam sa indemnati Guvernul sa asculte vocea lucratorilor si a partenerilor sociali si sa respecte drepturile validate de conventiile internationale privind legislatia muncii.
